3. Terms of Service

3.1 Acceptance of Terms

By accessing, browsing, or using ThaiActive ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must discontinue use of the Platform immediately.

3.2 Platform Role & Nature of Service

The Platform operates exclusively as a tour referral and booking facilitation service. We connect travelers with independent, third-party tour operators. We do not organize, operate, manage, conduct, or control any tours, travel experiences, or related services listed on the Platform.

Your contractual relationship for any tour or travel service is directly with the respective tour operator, not with this Platform. We act solely as an intermediary.

3.3 Delegation of Responsibility to Tour Operators

You expressly acknowledge and agree that all responsibility for the planning, execution, safety, quality, and delivery of any tour or travel service booked through this Platform rests entirely and exclusively with the respective third-party tour operator. This includes, but is not limited to, itinerary accuracy, changes, or cancellations made by the tour operator, the safety and well-being of participants during the tour, the conduct and qualifications of tour guides, staff, and subcontractors, compliance with all applicable local, national, and international laws and regulations, the accuracy of tour descriptions, images, and representations, and any injury, loss, damage, delay, or inconvenience experienced before, during, or after the tour.

This Platform assumes no liability whatsoever for any acts, omissions, errors, negligence, misconduct, or failures of any tour operator, their employees, agents, or subcontractors.

3.4 Insurance

Any and all travel insurance, trip protection, liability coverage, or similar insurance products associated with a tour booking are provided solely by the tour operator or their designated insurance provider. This Platform does not offer, underwrite, administer, or guarantee any insurance coverage of any kind.

You are strongly encouraged to review the specific insurance coverage included with your tour booking directly with the tour operator, understand the terms, conditions, exclusions, and limitations of any provided insurance, and consider purchasing additional independent travel insurance for your own protection.

Any insurance claims must be directed to the tour operator or their designated insurance provider. This Platform will not process, mediate, or be held responsible for any insurance-related matters.

3.5 User Accounts & Responsibilities

To use certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during registration, maintain the confidentiality of your account credentials, accept responsibility for all activities conducted under your account, and notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms of Service.

3.6 Booking & Payment

All bookings made through the Platform are subject to availability and the tour operator's own terms and conditions. Payments processed through the Platform are facilitated on behalf of the tour operator. The Platform may charge a non-refundable service or referral fee, which will be disclosed prior to booking confirmation.

3.7 Limitation of Liability

To the maximum extent permitted by applicable law, the Platform, its owners, directors, employees, affiliates, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform, any tour or service booked through the Platform, any actions or omissions of tour operators or their agents, the cancellation, delay, or modification of any tour, any loss of data, revenue, or profits, or any inaccuracies in tour listings or descriptions.

The Platform's total liability, if any, shall not exceed the amount of service fees paid by you to the Platform for the specific booking in question.

3.8 Indemnification

You agree to indemnify, defend, and hold harmless the Platform, its owners, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms of Service, your interaction with any tour operator, or any breach of applicable laws.

3.9 Dispute Resolution

Any disputes regarding tour quality, service delivery, refunds, or insurance claims must be resolved directly with the tour operator. This Platform may, at its sole discretion, assist in facilitating communication between you and the tour operator, but assumes no obligation or liability in the resolution of any disputes.

Any disputes between you and the Platform shall be governed by the laws of [Your Jurisdiction] and shall be resolved through binding arbitration or in the courts of [Your Jurisdiction], at the Platform's discretion.

3.10 Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, software, and design, is the property of ThaiActive or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent.

3.11 Prohibited Conduct

You agree not to use the Platform for any unlawful or unauthorized purpose, interfere with or disrupt the Platform's functionality, attempt to gain unauthorized access to the Platform's systems, post false, misleading, or fraudulent content, or use automated tools (bots, scrapers) to access the Platform without permission.

3.12 Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting on the Platform with a revised "Last Updated" date. Your continued use of the Platform after modifications constitutes acceptance of the updated terms.
